Labour Party just doesn’t understand…
The Labour Party has put out a press release saying that because they have been an advocate for making it easier to terminate employment, they have to explain why they haven’t terminated Alisdair Thompson’s employment.
The law currently insists you go through a certain disciplinary process, and you cannot just terminate employment without proving beyond doubt that there has been gross misconduct. Proving gross misconduct is almost impossible.
To say, as the Labour Party has done in this release, that “an ordinary worker on the job would have been fired by now” is either untruthful, or evidence that employers are breaking the Employment Relations Act. I will you to decide which one of those is true.
The fact of the matter is, the EMA does not have anything to answer for. They are ensuring that before they do anything, they are not breaching the law by doing it.
Also, I would suggest the Labour Party should know the Employment Relations Act, given it was drafted by Helen Clark’s Government…….
